Introduction

Welcome to SimCraft Golf Simulators (“SimCraft,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website, and apply to all purchases of our products and services, including residential and commercial golf simulator installations, consulting, and parts sales. By accessing our website, requesting a quote, or purchasing any product or service from us, you agree to be bound by these Terms.

Services

SimCraft provides:

  • Design, delivery, and installation of residential and commercial golf simulator systems.

  • Consulting services related to golf simulator design, equipment selection, and room planning.

  • Sales of golf simulator components and parts (including but not limited to enclosures, screens, turf, launch monitors, projectors, PCs, and accessories).

The exact scope of work, equipment list, pricing, and schedule for any given project will be set out in a written estimate, proposal, or invoice. If there is a conflict between these Terms and your signed proposal or contract, the signed document will control.

Quotes, Orders, and Payment

  • All quotes are estimates based on information provided at the time and may change if project scope, materials, or site conditions change.

  • A deposit is required to schedule an installation or to order products and custom materials. Deposits are generally non‑refundable once materials are ordered or work has begun, unless otherwise stated in writing.

  • Remaining balances are due as specified in your invoice or agreement (for example, upon shipment of equipment, substantial completion, or final completion).

  • Failure to pay on time may result in suspension of work, delay in delivery, removal of equipment not yet paid for, and/or assessment of late fees as permitted by applicable law.

Customer Responsibilities and Site Conditions

To allow SimCraft to perform installation services, you agree to:

  • Provide accurate measurements, photos, and other information requested for design and planning.

  • Ensure that the installation space is accessible, safe, and ready (including completed structural work, electrical outlets, internet connectivity, HVAC, lighting changes, and any necessary permits not explicitly included in our scope).

  • Obtain any required landlord, HOA, or building approvals, unless your written agreement specifically states that SimCraft will handle these items.

  • Move or protect furniture, equipment, and valuables not included in the project scope.

If site conditions differ from what was represented or require additional work (e.g., framing, electrical, structural modifications, network cabling, remediation of water damage), SimCraft may charge additional fees or reschedule work as needed.

Shipping, Delivery, and Risk of Loss

  • Products may be shipped directly to you, to your job site, or delivered by SimCraft or its partners.

  • Any shipping dates are estimates and not guaranteed. Delays caused by manufacturers, carriers, weather, or other events outside our control do not create liability for SimCraft.

  • Risk of loss for shipped items transfers to you upon delivery by the carrier, unless otherwise specified in a separate written agreement.

You agree to inspect deliveries promptly and notify us within a reasonable time of any visible damage or missing items so that we can assist with carrier claims or replacements as applicable.

Installation Standards and Limitations

SimCraft will perform services in a workmanlike manner consistent with industry standards for golf simulator installation. However, you acknowledge and agree that:

  • Performance of any simulator may depend on third-party hardware and software (e.g., launch monitors, game software, PCs, network quality) that SimCraft does not manufacture or control.

  • Room dimensions, ceiling height, lighting conditions, flooring, and other environmental factors may limit or affect the design, performance, and usability of the simulator.

  • Unless explicitly stated, structural changes, major electrical work, HVAC modifications, soundproofing, and architectural/engineering services are excluded from our standard scope.

Any changes requested after approval of the design or during installation may result in change orders, additional fees, and schedule adjustments.

Parts, Products, and Third‑Party Warranties

  • Many components used in our systems (launch monitors, projectors, PCs, software, etc.) are manufactured and warranted by third parties under their own terms.

  • SimCraft does not provide any independent warranty on third‑party products beyond what the manufacturer provides, unless expressly stated in writing.

  • You are responsible for registering products and following manufacturer instructions for use, maintenance, and warranty coverage.

Any issues covered by a manufacturer’s warranty will be handled in accordance with that manufacturer’s process. SimCraft may assist with troubleshooting and coordination as a separate or billable service if not included in your package.

Returns, Cancellations, and Rescheduling

Policies may vary by product and project; the following general rules apply unless a separate written agreement states otherwise:

  • Custom‑built items (e.g., custom-sized enclosures, screens, or structures) and special‑order equipment are typically non‑cancelable and non‑returnable once in production or ordered.

  • Standard products may be returnable within a defined period if unused and in original packaging; restocking fees and shipping costs may apply.

  • Installation cancellations or reschedules with short notice may incur fees to cover lost time, travel, or mobilization costs.

Details for a specific order will be shown in your quote, invoice, or project agreement and control over this general section if there is any conflict.

Use of the Simulator and Safety

You agree to use the golf simulator and related equipment in a safe and responsible manner, and to ensure that all users:

  • Follow all safety warnings and instructions provided by SimCraft and by equipment manufacturers.

  • Use appropriate golf balls, clubs, and accessories approved for simulator use.

  • Maintain a safe distance from swinging clubs, screens, and walls, and supervise minors at all times.

SimCraft is not responsible for injuries, property damage, or other losses arising from improper use, lack of supervision, or failure to follow safety guidelines.

Intellectual Property

All designs, drawings, layouts, and documentation created by SimCraft for your project (other than manufacturer instructions and manuals) remain the intellectual property of SimCraft unless otherwise agreed in writing. You receive a limited, non‑transferable license to use such plans and layouts solely for your location and for the installed system. You may not reproduce, distribute, or reuse SimCraft designs for other locations or projects without our written consent.

Website Use

By using our website, you agree not to:

  • Engage in any activity that disrupts or interferes with the website or servers.

  • Attempt to gain unauthorized access to any part of the site, user accounts, or data.

  • Use the site for any unlawful, fraudulent, or abusive purpose.

SimCraft may modify, suspend, or discontinue any part of the website at any time without notice.

Disclaimer of Warranties

Except as expressly stated in a written agreement signed by SimCraft, all products and services are provided “as is” and “as available” to the maximum extent permitted by applicable law. SimCraft disclaims all other warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement, with respect to its website, consulting services, installation services, and any information provided.

Limitation of Liability

To the fullest extent permitted by law:

  • SimCraft will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of use, business interruption, or loss of data, arising out of or related to our products, services, or website.

  • SimCraft’s total aggregate liability for any claims relating to a project, product, or service will be limited to the amounts actually paid to SimCraft for the specific project, product, or service giving rise to the claim.

These limitations apply whether the claim is based in contract, tort, negligence, strict liability, or any other legal theory, even if SimCraft has been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless SimCraft, its owners, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your misuse of the simulator, parts, or website.

  • Your breach of these Terms or any separate written agreement.

  • Any claims brought by third parties related to your use of the simulator or your premises.

Privacy

Any personal information you provide through our website, during the sales process, or during project execution will be handled in accordance with our Privacy Policy (if you have or plan to publish one). By using our website or doing business with us, you consent to the collection and use of your information as described in that policy.

Changes to These Terms

SimCraft may update these Terms from time to time. The “Last updated” date at the top will reflect the effective date of the latest version. Continued use of our website or services after any changes are posted constitutes your acceptance of the revised Terms.

Governing Law and Dispute Resolution

These Terms and any related agreements will be governed by and construed in accordance with the laws of the state where SimCraft is headquartered or where specified in your written contract, without regard to conflict of law principles. Any disputes not resolved informally will be handled in the state or federal courts located in that jurisdiction, unless a different forum or arbitration process is specified in your signed agreement.

Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any quotes, proposals, invoices, or written agreements you sign with SimCraft, constitute the entire agreement between you and SimCraft regarding the subject matter and supersede all prior discussions or understandings.
